CLUB 44 Booking Terms & Conditions
October 2026 - V.31
These Booking Terms and Conditions apply to Events organised by PREMIER GT CLUB44 LTD, a company registered in England and Wales under company number 12364659, whose registered office is Unit C1 The Hollow, Rock Business Park, Pulborough, England, RH20 3GR ("Club 44", "we", "us" and “our").
References to "you" and "your" mean the Lead Booker and, where relevant, each named participant on whose behalf the Lead Booker is authorised to contract. An "Event" is the Club 44 occasion or tour identified in your accepted Event booking schedule. That schedule includes the Event-specific details, price, payment and cancellation terms shown on the booking landing page and accepted before booking. The "booking price" is the total price agreed for your booking, not the total value of the Event for all participants.
You book the Event with Club 44. Your booking includes the accommodation and food and beverage arrangements described in the Event booking schedule, supplied under your contract with us using independent hotels and hospitality providers. We also provide suggested driving routes for participants to use at their own discretion. Participants arrange their own vehicles and transport, including any ferry, tunnel or other crossings. Club 44 does not provide passenger transport or transport participants' vehicles.
The Event booking schedule will identify the services included in your booking price, the relevant dates, accommodation details, included meals and drinks and any exclusions. The total price for the agreed arrangements, including any applicable taxes and compulsory charges, will be disclosed before booking. Optional extras must be expressly agreed before you are charged for them. Services you book independently do not form part of your Club 44 booking.
Please read these terms and all Event-specific information before booking and retain the copies supplied with your confirmation.
1. BOOKING AND FORMATION OF CONTRACT
1.1 Making a booking
Your contract with Club 44 is formed when we issue written booking confirmation, following your acceptance of the applicable booking and payment terms and our receipt of the required payment.
An acknowledgement of your enquiry or an automated payment receipt does not, by itself, constitute booking confirmation. If we cannot accept your booking, we will refund any payment received for it in full without undue delay.
Your confirmation will set out the principal details of the booking. You must check it carefully and notify us promptly of any error. A confirmation records the agreed booking and does not introduce new terms that you have not accepted.
1.2 Lead Booker
The person making the booking (the "Lead Booker") confirms that they are authorised to enter into the contract on behalf of every other named participant and to communicate booking instructions on their behalf. Each participant on whose behalf the Lead Booker is authorised to contract is a party to the booking agreement.
The Lead Booker must ensure that all members of the booking receive the relevant booking information, these terms and the participation requirements. Every driver must separately complete the acceptance required by clause 36.
Unless we agree otherwise in writing, the Lead Booker is responsible for paying the amounts properly due to Club 44 under the booking, including the balance, agreed amendment charges and cancellation charges payable under these terms. This does not make the Lead Booker automatically responsible for another participant's driving, misconduct or damage, and we will not recover the same amount twice.
1.3 Acceptance of terms
Before making a deposit or any other booking payment, you will be given the opportunity to review and actively accept these terms and the Event booking schedule, including the Event-specific price, deposit, final payment and cancellation terms. These Event-specific terms will be displayed on the booking landing page or supplied in writing for a manual booking. This requirement applies to online bookings, manually issued invoices and bank-transfer bookings.
We will record the version of each document and the Event-specific terms accepted, the identity of the person accepting them, the booking concerned and the date and time of acceptance. We will send copies with the written confirmation in a form that you can retain. Later changes to the landing page do not change the terms already accepted for your booking.
2. PAYMENT
2.1 Deposit
A reservation deposit is payable when booking, unless the full booking price is then due. Deposit amounts and payment schedules vary by Event and will be clearly stated in the Event booking schedule and payment terms before you commit to the booking.
The deposit is part-payment of your booking price, not an additional charge. Its treatment if the booking is cancelled is governed by clause 3 and the Event-specific cancellation schedule accepted before booking. All booking payments are made to Club 44, which pays the relevant suppliers. Your payment is for the agreed Event services at our selling price, not a payment of a separate hotel invoice on your behalf.
2.2 Balance
Unless a different deadline was disclosed and accepted before booking, the remaining balance is payable no later than eight weeks before the Event begins. For bookings made after the applicable balance deadline, the full booking price is payable when booking unless we agree otherwise in writing.
2.3 Failure to pay
If payment is not received by its due date, we will send the Lead Booker a written reminder specifying the outstanding amount, a further payment deadline and the consequences of non-payment. We will normally allow seven calendar days. A shorter reasonable period may be specified where the Event is imminent or a supplier deadline disclosed before booking makes this necessary; we will explain the reason.
If the amount remains unpaid after that deadline, we may cancel the booking by written notice and apply clause 3. Any charge remains subject to the accepted Event-specific limits, the calculation of our reasonable loss, the crediting of payments already received and your mandatory rights.
3. CANCELLATION BY YOU
3.1 Notice of cancellation
To cancel all or part of your booking, the Lead Booker must notify us in writing at the booking email address shown at the start of these terms or by post to our registered office. Please identify the booking and the participants or services being cancelled.
Cancellation takes effect when we receive your written notice, whether or not we have acknowledged it. We will acknowledge receipt promptly. Please contact us if you do not receive an acknowledgement, particularly where a cancellation deadline is approaching.
3.2 Cancellation charges
Cancellation terms vary by Event because hotel and other supplier commitments differ. The cancellation schedule shown on the Event booking landing page and accepted before booking forms part of your agreement. It will state the relevant notice periods and maximum charges, including the basis of any percentage or fixed amount. A copy will be included with your confirmation. There is no single cancellation-percentage schedule applying to every Club 44 Event.
The disclosed charges are maximums, not automatic entitlements to retain those amounts. If no Event-specific schedule was disclosed and accepted, we will not impose an undisclosed fixed or percentage charge; any lawful claim must instead be justified by the reasonable direct loss caused by the cancellation.
Any cancellation charge must be reasonable, must not exceed an applicable accepted maximum, and must reflect the direct loss caused by the cancellation. The calculation will take account, where relevant, of:
non-recoverable supplier commitments and reasonable supplier cancellation charges;
reasonable administration costs directly attributable to the cancellation;
genuine loss of net profit, where appropriate and not already reflected in another part of the calculation;
costs saved because the booking will not proceed;
supplier refunds, usable credits or other recoveries that reduce the loss; and
whether the cancelled place or services can reasonably be resold or put to an alternative use, and the income received or reasonably expected from doing so.
We will take reasonable steps to reduce our loss and will not charge twice for the same loss. On request, we will explain the calculation and its basis. If a later recovery reduces the loss charged to you, we will recalculate the charge and refund the resulting excess promptly.
Any deposit or other payment already made will be credited against the cancellation charge; it will not be retained in addition to that charge. A properly calculated charge may exceed the deposit paid, in which case the remaining amount is payable by the Lead Booker. Payments exceeding the charge will be refunded without undue delay.
Where only part of a booking is cancelled, the calculation will relate to the affected part. Any reasonable resulting change to the remaining arrangements, such as a room-occupancy price difference, will be explained and agreed before being implemented under clause 6. It will not duplicate a loss already included in the cancellation charge.
3.3 Mandatory rights and distance bookings
Cancellation charges remain subject to mandatory consumer rights and applicable law. A cancellation for which you have a legal right to a refund or to cancel without charge will not be treated as an ordinary customer cancellation merely because you notify us of it.
For accommodation, catering or qualifying leisure services booked for specified dates or a specified period, the usual 14-day cancellation right for distance contracts does not apply merely because the booking was made online or by telephone. This does not affect cancellation rights expressly provided by these terms, rights arising from failure to provide the contracted services or any cancellation right applicable to a different type of service.
3.4 Non-attendance and early departure
If you voluntarily fail to attend, arrive late, leave early or choose not to use an included service, you will not normally be entitled to a refund for services which remain available to you but which you elect not to use.
This does not affect a statutory right to a refund, price reduction or compensation arising because of our failure, or a supplier's failure for which we are legally responsible, to perform the contracted services properly.
4. EVENTS BEYOND OUR REASONABLE CONTROL
For this clause, circumstances beyond a party's reasonable control are circumstances whose consequences could not reasonably have been avoided even if all reasonable measures had been taken. Examples may include serious security problems, war, terrorism, significant public-health risks, natural disasters, serious adverse weather, major road or border closures and government restrictions.
If such circumstances prevent or materially affect the services we have agreed to provide, we will notify you promptly and take reasonable steps to reduce the disruption. Significant proposed changes will be dealt with under clause 7.
If we cancel the whole Event before it begins, including because of circumstances covered by this clause, the full-refund promise in clause 5 applies. If only part of the contracted services cannot be provided and no substitute is agreed, we will explain which services are cancelled and refund the appropriate amount for those services, preserving any wider remedy required by law. This will not be treated as cancellation by you under clause 3.
Payment of a refund that we owe you will not depend on us first recovering money from a hotel or another supplier. Supplier refusal, delay or insolvency does not by itself remove an existing refund obligation owed by Club 44.
We will pay any refund due under this clause without undue delay and within 14 days after cancellation of the affected services, unless the law requires earlier payment. An alternative Event or credit will replace a refund only if you agree to accept it. Your other legal rights remain unaffected.
Where the contracted services remain available but your personal circumstances prevent attendance, clause 3 will normally apply, subject to any legal right you have to cancel without charge.
5. CANCELLATION BY CLUB 44
We may cancel an Event where reasonably necessary because it cannot be provided safely or as contracted, including in circumstances covered by clause 4, or where a minimum-attendance condition meeting the requirements below has not been satisfied. Cancellation of an individual booking for non-payment or serious misconduct is dealt with under clauses 2.3 and 18 respectively.
A minimum-attendance condition applies only if the required minimum and the latest date on which we may cancel for that reason were clearly stated in the Event booking schedule and accepted before booking. We will not introduce such a condition afterwards or rely on it after the disclosed deadline.
If Club 44 cancels the whole Event before it begins, we will refund all monies you have paid to us for that Event, including your deposit and any balance paid. This applies whether or not our hotels or other suppliers refund us, and includes cancellation for insufficient attendance or circumstances covered by clause 4. We will not deduct a booking fee, administration fee or supplier cancellation charge from that full refund.
If the Event has begun and we cancel the remaining arrangements, we will refund the appropriate amount for contracted services not provided, without limiting any greater refund, price reduction or other remedy required by law.
We may offer an alternative Event or a credit, but you do not have to accept it instead of a refund. Refunds under this clause will be paid without undue delay and within 14 days of cancellation, unless an earlier legal deadline applies.
This clause does not limit any additional remedy to which you are legally entitled. Services booked independently by you are separate arrangements; any responsibility we have for related losses is governed by clause 22 and applicable law.
6. CHANGES REQUESTED BY YOU
Please notify us in writing at the booking email address as soon as reasonably possible if you wish to amend a booking. We will use reasonable efforts to accommodate the request but cannot guarantee that a change will be possible.
Where a change is possible, we will explain the total proposed charge, including any reasonable administration fee, additional supplier charge and price difference, and obtain your agreement before implementing it.
An administration fee of up to £50 per affected person may apply where reasonable for the work involved. It will relate only to the person or persons whose arrangements are amended, not automatically to everyone on the booking. The same work will not attract duplicate administration charges under this clause and clause 11.
A request to change the Event, dates or number of participants may require cancellation and rebooking where the original arrangements cannot reasonably be amended. We will explain any cancellation charge, including any effect on room occupancy or remaining services, before you decide whether to proceed.
7. CHANGES BY CLUB 44
7.1 Minor changes
Driving Events may require adjustments because of road closures, weather, supplier requirements, safety or other reasonable operational considerations. We may make genuinely insignificant changes where reasonably necessary, provided they do not materially reduce the agreed standard or alter an essential feature of your booking.
We will notify you promptly of a change that affects something you need to do or know for the Event. This clause does not permit us to disregard specific information that forms part of your contract.
7.2 Significant changes
If, before the Event begins, we propose a change that materially alters the agreed dates, destination, accommodation standard or another essential feature of your booking, we will explain it without undue delay and give you a reasonable opportunity to accept it, agree a suitable alternative if offered, or cancel the affected booking without a cancellation charge.
Where the change materially undermines the purpose of your booking as a whole, you may cancel the whole booking and receive a refund of the payments received for it. Otherwise, we will refund the appropriate amount for the cancelled part. Refunds under this clause will be made without undue delay and within 14 days of cancellation, unless the law requires earlier payment.
We will state a reasonable response deadline and explain the available options. Silence will not be treated as acceptance of a significant change. Any alternative arrangements require your agreement.
If a significant change becomes necessary during the Event, we will inform you promptly, discuss reasonable alternatives and provide the remedies required by law. Nothing in this clause limits those remedies.
7.3 Route changes
Changes to a suggested route caused by road closures, traffic, weather, safety concerns or similar operational matters will not ordinarily constitute a significant change where the principal contracted services and overall Event remain substantially unaffected.
However, removal of a prominently advertised driving highlight will not automatically be treated as insignificant merely because accommodation remains available. Its significance will be assessed against what was agreed and the overall purpose of the booking.
8. PRICE CHANGES
Once your booking is confirmed, its agreed price is fixed. It will change only where you request an amendment or additional service and agree the resulting charge under clause 6. We will not increase the price of the original confirmed arrangements because of subsequent supplier-price or currency movements.
9. DELAYS AND DISRUPTION
Journeys to, from and during an Event can be affected by traffic, ferry or tunnel disruption, mechanical problems, strikes, weather, border delays and other circumstances. You should allow reasonable contingency time for your independently arranged journeys.
Club 44 will not be responsible for additional costs or losses resulting solely from circumstances for which it is not legally responsible. Nothing in this clause limits our responsibility for our own breach of contract or negligence, or any liability preserved by clause 22.4. Practical assistance with incidents and disruption is addressed in clause 20.
10. TRAVEL INSURANCE
Each participant must maintain suitable insurance appropriate to their personal circumstances and the Event. Relevant cancellation cover should be in place from booking, with any other required cover maintained throughout the Event and associated journey.
Depending on the Event and your circumstances, cover should address cancellation, medical treatment, emergency assistance, personal possessions and personal repatriation where relevant. Requirements for a domestic Event may differ from those for an overseas Event.
You are responsible for checking that your cover is adequate and that relevant activities and personal circumstances have been disclosed to the insurer. Club 44 may request reasonable evidence of appropriate cover before the Event.
Club 44 does not advise on or guarantee the adequacy of an individual insurance policy. Any request to see evidence is an administrative check, not confirmation that a claim will be covered. Insurance does not replace Club 44's responsibilities under these terms or applicable law.
11. TRANSFER OF BOOKINGS
Please contact us as soon as reasonably possible if you wish to substitute another participant. We will consider the request reasonably. The replacement must meet the applicable participation requirements, and the transfer must be capable of being accommodated by the relevant suppliers.
We will explain any reasonable administration charge, supplier charge or price difference before you agree to proceed. Clause 6 applies to the administration fee and prevents duplicate charging for the same work.
A transfer is effective only when confirmed by us in writing. Our confirmation will identify the replacement participant and any agreed change to payment responsibility. A replacement driver must separately meet clauses 15, 17 and 36. Your mandatory rights remain unaffected.
12. PASSPORTS, VISAS AND FOREIGN TRAVEL
You are responsible for checking and satisfying the passport, visa, immigration, health and other entry requirements applicable to your personal circumstances and itinerary, except for information we are legally required to provide.
Requirements may change and participants should check official sources before travelling. We will not be responsible where you cannot travel because you have failed to satisfy a requirement that was your responsibility, except where our own breach of a legal obligation caused or materially contributed to the problem.
13. NATURE OF CLUB 44 DRIVING EVENTS
13.1 Social road tours
Club 44 Events are social road tours. Club 44 does not provide driving tuition, performance-driving instruction, racing, competitive driving, speed trials, timed public-road sections or any requirement to maintain a particular speed or position within a group.
13.2 Independent driving
Each driver remains responsible for their own vehicle and driving decisions, including:
their manner of driving, speed, positioning and overtaking decisions;
route selection and the decision whether to follow a suggested route;
compliance with road signs, restrictions and applicable laws;
assessment of road, traffic and weather conditions; and
deciding whether it is safe to continue or whether to stop, change route or disengage.
Club 44 does not control or supervise the manner in which participants drive their vehicles. Drivers' responsibilities do not remove our responsibility to exercise reasonable care and skill in the services we agree to provide.
13.3 No obligation to keep up
There is no requirement to keep up with another vehicle, convoy, lead vehicle, Event host or Event timetable. Participants must never increase their speed, make an unsafe manoeuvre or disregard prevailing conditions to remain with a group.
Meeting and arrival times are intended for Event coordination and must never be treated as deadlines requiring unsafe or unlawful driving.
13.4 Freedom to disengage
Participation in any group-driving element is voluntary. You may leave the group, stop, take another route, proceed independently, miss a planned stop or cease driving altogether.
A participant who considers a road, route, weather condition, group-driving situation or other circumstance unsuitable must exercise their own judgement and take appropriate action.
Where reasonably practicable and safe, please notify the Event contact if you leave the group or will not attend a planned meeting point, so that we do not unnecessarily treat you as missing or in difficulty.
14. ROUTES, NAVIGATION AND ROAD CONDITIONS
14.1 Suggested routes
Routes, road books, GPX files, satellite-navigation files, maps, meeting points, timings and other navigation information supplied by Club 44 are guidance only, not driving instructions. Participants remain free to follow, amend or disregard them.
We will exercise reasonable care and skill when preparing and communicating suggested routes. This does not guarantee that every road will remain open or be suitable for every vehicle. Drivers must assess conditions as they encounter them.
14.2 Driver assessment
Before and while following a suggested route, drivers must independently assess road conditions and closures; traffic and vehicle restrictions; weather and visibility; road width; vehicle dimensions and ground clearance; low-emission and restricted zones; local traffic laws; and any other factor relevant to safe and lawful driving.
14.3 Changes to roads
Road conditions may change without notice. Club 44 cannot guarantee that a suggested road will remain open, unrestricted or suitable for every vehicle when it is reached. Drivers must exercise their own judgement and select an alternative where appropriate.
14.4 Navigation systems
Satellite-navigation systems and digital route files may contain inaccuracies or become outdated. Drivers must obey actual road signs, applicable traffic laws and lawful directions in preference to any navigation instruction.
15. DRIVER ELIGIBILITY, LICENCES AND FITNESS TO DRIVE
Every person driving during an Event must:
hold a full and valid driving licence appropriate for the vehicle;
be legally entitled and authorised to drive the vehicle in every country through which they travel;
comply with licence, permit and international driving permit requirements;
be fit to drive the relevant vehicle safely, including with any lawful adaptations or licence conditions that apply;
comply with restrictions applying to their licence; and
immediately cease driving if illness, fatigue, medication, injury or another condition makes continued driving unsafe or unlawful.
Club 44 may request reasonable evidence of eligibility before or during the Event. Where satisfactory evidence is not supplied, we may refuse that person's participation in the driving elements.
Inability to participate as a driver does not automatically prevent attendance as a passenger where suitable arrangements are available. Any amendment or cancellation of the remaining booking will be assessed under the relevant clauses; it does not automatically forfeit the whole booking price.
16. VEHICLE RESPONSIBILITY AND ROADWORTHINESS
16.1 Participant responsibility
The driver and owner are responsible, as applicable, for ensuring that a vehicle brought to an Event is road legal, appropriately registered, taxed where required and covered by a valid MOT or equivalent where required. It must be properly maintained, mechanically suitable for the journey, fitted with road-legal tyres, compliant with applicable local laws and otherwise safe and roadworthy.
16.2 Vehicle documents and equipment
Participants must carry the documents and equipment legally required in the countries through which they travel. These may include registration and insurance documents, environmental permits, safety equipment and other locally required items.
16.3 Vehicle failure
Vehicle breakdown cover, recovery, repair, storage and vehicle repatriation are not included in your Club 44 booking. Participants must make suitable arrangements for these risks. Nothing in this clause excludes liability which Club 44 cannot lawfully exclude.
17. MOTOR INSURANCE
17.1 Required cover
Every participating vehicle must have appropriate motor insurance valid throughout the Event and every country through which it will travel. Participants must satisfy themselves with their insurer that their policy provides appropriate cover for their participation.
17.2 Insurance confirmation
Where relevant to the vehicle and journey, participants should obtain confirmation that their arrangements cover:
every person who may drive, including replacement and additional drivers;
each relevant country and territory;
participation in an organised social road tour;
the appropriate insured value of the vehicle and any declared modifications;
vehicle recovery and repatriation where required; and
any territorial documentation required by the insurer or applicable law.
Breakdown, recovery and repatriation protection may be provided under a separate policy or assistance arrangement rather than under the motor policy itself.
17.3 Evidence
Club 44 may request reasonable evidence of valid motor insurance before departure. If satisfactory evidence is not supplied, we may refuse the affected vehicle or driver permission to participate in the organised driving elements. The treatment of other arrangements will be assessed under the applicable booking clauses, rather than automatically forfeited.
Reviewing evidence does not amount to insurance advice or a guarantee of cover. Participants remain responsible for checking the policy terms and exclusions with their insurer.
17.4 Failure to obtain insurance
To the extent permitted by law, you are responsible for reasonable losses and expenses directly incurred by Club 44 because of your failure to obtain insurance which you were expressly required to maintain under these terms. We will explain and provide reasonable evidence of any amount claimed.
This does not make you responsible for losses caused by Club 44's own breach or negligence, or permit recovery of an amount already recovered from another source.
18. CONDUCT AND SAFETY
Participants must behave responsibly and with reasonable consideration for other participants, Club 44 personnel, suppliers, other road users and members of the public. The following conduct is prohibited:
racing, competitive driving or timed driving on public roads;
exceeding applicable speed limits or driving dangerously, carelessly or recklessly;
attempting to keep pace with another vehicle where unsafe or unlawful;
driving an unsafe or materially unroadworthy vehicle;
driving while impaired by alcohol, illegal drugs, medication or another substance;
threatening, abusive, discriminatory or violent behaviour;
deliberately damaging property; or
conduct creating a material risk to another person.
If we reasonably consider conduct dangerous, unlawful, seriously disruptive or likely to cause significant distress, injury or property damage, we may require the participant to stop the relevant activity and, where proportionate, terminate their participation.
Where appropriate and safe, we will give a warning and an opportunity to correct less serious conduct. We may act immediately where reasonably necessary for safety or because the misconduct is sufficiently serious.
Where participation is terminated for serious misconduct, any refund for unused services will be assessed taking account of services already provided, our reasonable losses, costs saved and amounts recovered or reasonably recoverable. There is no automatic entitlement to retain the whole remaining booking price.
The participant remains responsible for reasonable additional costs directly caused by their misconduct. We will explain and evidence any amount claimed and will not recover the same loss twice. Clause 20 addresses practical assistance, and the rights preserved by clause 23 continue to apply.
19. ALCOHOL, DRUGS AND IMPAIRING SUBSTANCES
No participant may drive while over the applicable legal alcohol limit or while their ability to drive safely is impaired by alcohol, illegal drugs, prescription medication, non-prescription medication or any other substance.
Participants remain responsible for understanding the drink-driving and drug-driving laws in every country visited. The availability of wine or alcoholic beverages at a social meal or other gathering during an Event must never be interpreted as an indication that driving afterwards is safe or lawful.
Club 44 may refuse to permit participation in an organised driving element where we reasonably believe that person is unfit to drive.
20. ACCIDENTS, INCIDENTS AND BREAKDOWNS
A participant involved in a significant accident, collision, breakdown or other material incident during an Event must notify Club 44 as soon as reasonably practicable where the incident may affect the Event or other participants. Notification must not delay emergency assistance or essential safety measures.
Participants remain responsible for complying with local reporting requirements, contacting emergency services where necessary, exchanging legally required information, notifying their insurer, arranging recovery and following the requirements of their insurance and breakdown providers.
Club 44 may provide reasonable practical assistance but does not replace emergency services, insurers, recovery providers or other professional services. Any assistance we agree to provide will be given with reasonable care and skill.
Where you ask us to help arrange chargeable, non-emergency assistance, we will obtain your agreement to the charge before committing you to it. Nothing in this clause removes an obligation imposed on us by law.
21. FINES, TOLLS AND LAW ENFORCEMENT
Tolls, congestion and low-emission-zone charges, parking and similar journey costs are your responsibility unless expressly included in the Event booking schedule. Fines, speeding penalties and other penalties arising from your vehicle, driving or conduct remain your responsibility.
Club 44 is not responsible for actions taken by police, courts, road operators, border authorities, customs authorities, vehicle authorities or other public bodies, except to the extent that our own wrongful act or omission caused or materially contributed to the relevant loss.
If we reasonably incur a charge or expense directly because of your unlawful conduct or failure to pay a charge that was your responsibility, you must reimburse the reasonable amount incurred, to the extent permitted by law. We will identify the expense and provide supporting evidence. We will not recover the same expense twice.
22. OUR RESPONSIBILITY FOR YOUR BOOKING
22.1 Reasonable care and skill
Club 44 will perform the services it agrees to provide with reasonable care and skill.
22.2 Accommodation and included hospitality
The accommodation and included food and beverage services identified in your Event booking schedule are supplied under your contract with Club 44. We are responsible for providing the services described in your accepted booking details. We contract with independent hotels and hospitality providers to deliver them, but their involvement does not remove our contractual responsibilities to you. Club 44 is your contracting supplier for those included services, rather than acting solely as a booking agent.
If a problem arises, please notify both the relevant provider and Club 44 promptly so that we have a reasonable opportunity to address it. Hotel or other supplier operating rules do not displace your rights under your contract with Club 44. Service complaints, remedies and refund timing are addressed in clause 22.6; genuinely additional goodwill payments are addressed in clause 22.7.
22.3 Participant driving risks
Subject to our obligations under applicable law, Club 44 will not be responsible for loss or damage caused solely by:
a participant's driving decisions or behaviour;
speeding or other traffic offences;
an unsafe or defective participant vehicle or inadequate vehicle maintenance;
mechanical failure unrelated to anything Club 44 has done;
a participant's decision to follow or disregard a suggested route;
ordinary road conditions or another road user's conduct; or
a participant's failure to comply with applicable law or obtain required insurance.
This clause does not apply where an act or omission by Club 44 caused or materially contributed to the relevant loss.
22.4 Matters we do not exclude
Nothing in these terms excludes or limits liability for:
death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
breach of statutory duty where liability cannot lawfully be excluded;
your statutory rights under applicable consumer legislation; or
any other liability which cannot lawfully be excluded or limited.
22.5 Losses for which we are not responsible
Subject to applicable consumer law, Club 44 will not be responsible for losses that were not reasonably foreseeable when the contract was entered into or that are unrelated to the breach complained of. Loss is foreseeable if it is an obvious consequence of a breach or was within the reasonable contemplation of both parties when the contract was made.
Nothing in this clause limits rights that cannot legally be limited.
22.6 Service problems and refunds
We will investigate a reported service failure promptly and may ask you and the relevant supplier for information reasonably needed to assess it. Where practical and appropriate, we will seek to put the problem right during the Event, within a reasonable time, without significant inconvenience to you and without charging you to correct a failure for which we are responsible. Any material substitute requires your agreement. You do not have to accept an inadequate or impractical remedy.
Where a failure to provide contracted services gives you a right to a price reduction, refund or other remedy, we will provide that remedy in accordance with applicable consumer law. The appropriate response will depend on what was promised, the nature and impact of the failure, the affected services and any effective remedy already provided. A complaint does not automatically entitle you to a refund of the whole Event price, but nothing in this clause restricts a full refund or additional compensation where legally due.
Any price reduction will be assessed against the agreed selling price and the value of the affected services, rather than being automatically limited to our supplier cost or the amount recovered from a supplier. We will not require the supplier to approve your claim before recognising a refund obligation owed by Club 44.
Where you are entitled to a refund under section 56 of the Consumer Rights Act 2015, we will pay it without undue delay and no later than 14 days beginning with the day on which we agree that you are entitled to it. Any earlier applicable legal or contractual deadline continues to apply. We will not unreasonably withhold or delay recognising an entitlement to a refund. Investigation will not be used to defer a refund already established as due, and an unresolved additional claim will not delay an amount already agreed.
Any other refund due will be paid within the applicable legal or contractual deadline, or without undue delay where no deadline is specified. We will use the original payment method unless you expressly agree otherwise, and will not charge a refund fee. Payment of a refund that Club 44 owes you is not conditional on recovery from a hotel or another supplier.
22.7 Additional supplier goodwill payments
Where, separately from any amount we owe you, we agree to seek and pass on an additional voluntary goodwill payment from a supplier, we will explain that arrangement in writing. Unless we separately promise to fund it ourselves, that additional payment depends on funds actually received for your benefit. We will pass on the amount received for you without undue delay and within 14 days of receipt. This does not replace, reduce or delay your existing rights or any refund or compensation owed by Club 44. A supplier payment that reimburses us for an amount already paid to you does not create a second entitlement to the same amount.
23. MANDATORY CONSUMER RIGHTS
Nothing in these terms affects mandatory consumer rights or legal protections applicable to your booking. Club 44 will provide the information and remedies required by applicable law.
24. SUPPLIERS
We use independently operated hotels and hospitality providers to deliver the accommodation and food and beverage services included in the Event booking schedule. Club 44's contractual role and responsibility for those included arrangements are explained in clause 22.2.
Event-specific payment and cancellation terms applicable to your booking will be provided and accepted before you commit. Participants must also comply with reasonable supplier operating and safety rules notified to them. Those rules do not introduce undisclosed material charges or cancellation terms, or override your Club 44 contract or mandatory consumer rights. A supplier agreement made with Club 44 does not by itself become a separate accommodation contract between you and that supplier.
Transport and other services booked independently by participants do not form part of the Club 44 booking. A recommendation or suggested stop is not, by itself, an undertaking by Club 44 to supply that third-party service. This does not exclude responsibility for our own breach or negligence in a service we agree to provide.
25. DESCRIPTION AND ACCURACY OF EVENT INFORMATION
We take reasonable care to ensure that information and prices provided by Club 44 are accurate. Descriptions, photographs and marketing materials are intended to provide a reasonable representation of an Event, although minor details may vary.
If we discover a genuine error before a contract is formed, we may correct it and explain the corrected information before you commit. If a material pricing or description error is discovered after confirmation, we will contact you promptly and deal with it fairly and in accordance with applicable law.
This clause does not permit a material change otherwise than under clause 7 or remove responsibility for specific information forming part of your contract. A specifically agreed hotel, room category or parking arrangement is not treated as merely illustrative.
26. PRIVACY AND PERSONAL DATA
Club 44 will process personal data in accordance with applicable data-protection legislation and our Privacy Notice. The notice explains how information is used, shared and retained and how to exercise your rights.
We will make our Privacy Notice available when we collect your personal data. A copy is also available on request by email to events@club44.co.uk or by writing to: Privacy enquiries for Club 44, c/o Premier GT, Rock Business Park, Washington, West Sussex, RH20 3GR.
Information reasonably required to administer and perform your booking may be shared with the relevant hotels, restaurants and other hospitality providers where necessary for the agreed arrangements. We will explain the relevant uses in the Privacy Notice.
Where we request information about allergies, dietary requirements, disabilities, medical circumstances or other special-category personal data, it will be handled in accordance with data-protection law and our Privacy Notice. Where explicit consent is legally required for a particular use, it will be requested separately and will not be treated as automatically granted by accepting these terms.
Consent to direct marketing will also be obtained separately where required. The email and postal contact above may also be used for privacy questions and requests concerning Club 44.
27. PHOTOGRAPHY AND VIDEO
Club 44 may arrange photography and filming at Events. Where images are intended for promotional, marketing or social-media use, participants will be given appropriate information about that use. Where consent is the appropriate lawful basis, it will be obtained separately from acceptance of these terms.
Please send any photography or privacy concerns to the booking email address, preferably before the Event, or raise them with the Event contact during the Event. We will provide a reasonable process for concerns and, where practicable, an option to avoid identifiable promotional photography.
Where requested and reasonably practicable, Club 44 will obscure a participant's vehicle registration before publishing promotional imagery. We will handle any objection or withdrawal of consent in accordance with applicable law and our Privacy Notice.
These arrangements concern photography commissioned or published by Club 44. Other participants may take their own lawful photographs, over which Club 44 does not have editorial control. All participants must respect others' privacy and applicable law.
Nothing in these terms requires a participant to waive statutory privacy, data-protection, copyright or defamation rights.
28. DASHCAMS, GPS AND TRACKING
Participants may use lawful dashcams or other recording equipment in their own vehicles provided that use complies with applicable laws.
Where Club 44 uses GPS, radio or location-sharing technology for legitimate Event coordination or safety purposes, participants will be informed in advance about the system, who can access location information and when sharing ends. Any personal data will be processed in accordance with our Privacy Notice and applicable law.
Location sharing is not a continuously monitored emergency service. Participants must contact emergency services directly where required and must not operate navigation or communication equipment in a way that compromises safe driving or breaches the law.
No tracking or location information supplied by Club 44 amounts to supervision or control of a participant's driving.
29. COMPLAINTS
If you experience a problem during an Event, please notify a Club 44 representative as soon as reasonably practicable so that we can investigate and, where possible, resolve it. Where appropriate, please also raise a supplier issue with the supplier.
If the matter remains unresolved, contact us in writing at the booking email address or registered office as soon as reasonably possible after your return, with sufficient information to investigate. We recommend doing so within 28 days because prompt notice assists investigation. This is a requested timeframe, not a deadline removing or restricting your statutory or common-law rights.
We aim to acknowledge a written complaint within five working days and provide a substantive response within 28 calendar days. If we need longer, we will explain why and give a revised response date. These targets do not extend a statutory refund deadline or other legal time limit.
When communicating the outcome of our consideration of a complaint, we will identify any applicable alternative dispute resolution or other arrangements that we are legally required to make available or notify to you. Where we agree to use another dispute-resolution process, we will explain its terms before you agree to participate. Nothing in this clause requires you to accept compulsory arbitration or removes a right to bring court proceedings.
30. THIRD-PARTY RIGHTS
The named participants on whose behalf the Lead Booker is authorised to contract under clause 1.2 are parties to the booking agreement, not unrelated third parties.
Except where these terms expressly state otherwise, a person who is not a party to the contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce a term of it. This does not affect a right or remedy that exists independently of that Act.
31. SEVERABILITY
If a provision is unlawful or unenforceable, the remainder of the agreement will continue in effect so far as it can do so without that provision.
32. NO WAIVER
If either party does not immediately exercise a right or remedy under this agreement, that does not mean the right or remedy has been waived. Exercising a right on one occasion does not prevent it from being exercised again where appropriate.
33. VARIATION
The terms accepted when your contract is formed apply to your booking. Publishing revised terms does not change an existing booking. Changes to an existing agreement require your express agreement unless required by law.
This does not prevent operational changes expressly permitted by clause 7. Payment terms must be part of the accepted agreement, not introduced afterwards as a new exception to it.
34. ENTIRE AGREEMENT
The agreement concerning your booking consists of:
these Booking Terms and Conditions in the version you accepted;
the Event-specific booking schedule, including the price, deposit, final payment and cancellation terms accepted before booking payment;
the written confirmation recording your agreed booking;
the applicable version of the Driver Participation Declaration and Road Tour Rules, made available before booking and accepted as required by clause 36;
material pre-contract information forming part of your booking; and
any other conditions or subsequent changes expressly agreed between you and Club 44.
The accepted Event-specific schedule supplies the applicable dates, price, payment timetable and cancellation maximums referred to in these general terms. It otherwise overrides a conflicting general term only where the difference was clearly identified and agreed before booking, or subsequently expressly agreed as a variation. It cannot remove a mandatory consumer right. A later confirmation or landing-page update does not introduce a new restriction merely by including it.
Nothing in this clause removes the effect of specific information on which you relied and which forms part of your contract, excludes liability for fraud or fraudulent misrepresentation, or restricts a consumer right that cannot legally be excluded.
35. LAW AND JURISDICTION
These terms and your contract with Club 44 are governed by the law of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory consumer right entitling you to bring proceedings in another court, including any applicable right to bring proceedings in the part of the United Kingdom in which you live. Nothing in this clause removes a consumer jurisdictional protection provided by mandatory law.
36. DRIVER PARTICIPATION DECLARATION
Every person intending to drive during an Event must separately accept the Driver Participation Declaration and Road Tour Rules applicable to that booking before participating in the driving elements. The relevant version will be made available before booking.
The declaration will include confirmation that the driver:
holds an appropriate valid driving licence and is fit to drive the relevant vehicle safely;
is authorised to drive the vehicle and has ensured that it is roadworthy;
has appropriate motor insurance for the drivers, countries and Event;
understands that routes and timings are suggestions only and Club 44 does not supervise or control their driving;
will comply with applicable road laws and will not race, undertake timed or competitive public-road driving, or drive while impaired;
understands there is no obligation to keep up and that they may leave the group or take another route at any time; and
will notify Club 44 of a material accident or incident affecting the Event as soon as reasonably practicable, without delaying emergency action.
A replacement or additional driver must independently satisfy the requirements and accept the applicable declaration before driving as part of the Event.
Operational safety briefings may be updated to reflect actual conditions. They will not be used to introduce new cancellation charges, liability exclusions or other materially different contractual restrictions after booking.
IMPORTANT PARTICIPANT NOTICE
Club 44 Events take place on public roads. They are not races, rallies, speed trials or competitive driving events.
Every driver remains responsible for their own vehicle and driving decisions. Suggested routes, navigation files, group positions and arrival times are provided for convenience only. There is never a requirement to keep up with another vehicle or follow a route that the driver considers unsafe, unsuitable or unlawful.
Nothing in these terms excludes or limits liability or a statutory right that cannot lawfully be excluded or limited.
